I was wondering if anyone had any advice on how I could serve a Plaintiff's Claim on a defendant that has been evading being served.
I tried FedEx, but the outcome was "client not available" each time FedEx tried to deliver the documents.
After several attempts, FedEx left a note at the defendent's door and followed up with a phone call to the defendent indicating that they can pick up the package at the local FedEx location, however, it's been one week, and the package has not been picked up.
I tried door-knocking myself, at several different hours of the day… and received no response… or the defendent wouldn't open the door. Not to mention, getting into the defendent's condo building, without buzzing him, and getting past security was a feat in itself!
Does anyone know how I can serve the documents on him, in accordance with the small claims court rules of service, in a way that he will surely get the documents without me having to continue trying to track him down to serve them personally? (I contemplated hiring a process server, but they are quite costly and I don't have the financial means for that right now.)
Any help is greatly appreciated.
(I know that in other courts, simply mailing the documents to be served or sending them by courrier with a receipt that they have been sent is sufficient, but supposedly this isn't the case in SCC.)
