i hate my neighbor and her stupid gnomes – all over her garden. one day I had a beer or two and just smashed them all – now she wants to take me to court . Please tell me she cant!

She can sue you in the small claims court and you could be forced to pay her court costs on top of the payment for damages. Try talking to her and settling the situation yourselves or ask her to go to mediation with you. Here you can sort out the problem with the help of a mediator and it will cost you both less.
