Homeless people sleep in the park

Hi, my name is Jess and I live opposite Centennial park in Victoria. I go there regularly to walk my dog. Recently I notice that the homeless are camping in the park again! I am sure there was a law prohibiting them from sleeping in tents during the daytime and I wander what is happening. Is it legal to do so? Shall I report to the police station?

Dear Jess,

Yes you are right, there used to be a law prohibiting homeless people from camping in the park. It used to be considered a public offence under the Victoria bylaw. However, as of last Wednesday, there has been a new law passed by the B.C. Court of appeal  that overrules the old one. It gives homeless people the right to build temporary shelters in the park if the government cannot provide them with proper housing.
