worried

Hey, my little girl was hit with a piece of masonry which fell from our apartment ceiling. We told the landlord he is to blame but he says it is all our fault  – who is right?

How was the ceiling damaged? Do you occupy the floor above? is the ceiling moist or showing water/mould damage?

According to the Residential Tenancy Act the landlord is responsible for the maintenance of the rental property and he or she is legally bound to keep the property in a good state of repair, which makes the property fit for habitation. Therefore the property must fulfill all standards of housing, maintenance, health and safety. You should consult with your nearest Residential Tenancy Board.
