Everyone has their own private reasons for getting a divorce, however, the breakdown of the marriage is the only legal reason needed to get a divorce in Canada. If you have lived apart from your partner for over one year this is enough evidence under Canada Divorce Law to prove that the marriage has broken down. The reasons for a divorce do not affect the way custody, access and support to children is decided or the way that property is divided. Divorcing on the grounds of a one year separation is the cheapest and easiest way to file for a divorce in Canada. If your wife has been living alone for a year she could apply for a divorce on the basis of one years separation but if you have been home and had a relationship within the last year she will not be able to divorce on these grounds.
