I desperately want to bring my son back to Edmonton. My ex-wife moved my son who is 9 years old to Florida without my consent. Recently my son was hysterically crying about coming back to Edmonton when he is so upset it hurts and breaks my heart even more. He said he hates Florida and his mom threw his paintings he made on the floor and told him to go back to edmonton and stop making her miserable". If she doesnt want him any more bring him back to me I am desperate for him
The last two emails I got from my current lawyer:
1. "I cannot do anything until the court sign and faxes the order to show cause to my office. I should also let you know that your wife's lawyer has filed (a similarly as of yet unsigned) order to show cause for the child support and legal fees owed. I shall be opposing said motion.
2. I have now just received your wife's motion, which essentially seeks permission to relocate to florida and additional attorney fees. I need you to come into the office as soon as possible, take a copy of the motion with you, review it thoroughly and provide a point by point response(via e-mail) to the arguments of the attorney and your wife, by this weekend. I will therafter prepare a set of opposition papers for you to sign next week.
There is no doubt in my mind that there will now be a 'double' trial- for relocation(her request) and custody(your request).
Having just recently tried such a relocation case, please be advised this will be very expensive, if we have to prepare and/or proceed to trial.

I am also thinking that maybe I should be just fighting for RELOCATION to edmonton and not custody, or just going down to FL and bringing her back so at least she is safe and happy? She did it to me didnt she!

How long has your ex wife been living in Florida? From what I understood she wouldn't be able to file anything in the courts until she has been living there for 6 months. Has she been there for at least six months?

The very first thing I would suggest to you do is seek an order having your daughter returned to Edmonton until the hearing on relocation.

As for just going to get her…I personally think it could be a bad idea just because it would cause more problems for you son as your ex wife would involve police etc and it may even may make more problems for you in the long run with custody matters as you would be breaking the law.
