Hello,


I need your help I have a husband who is currently in Prison for fraud, he has got around 2.2Million dollars. I want to divorce him but i dont know on with grounds plus will i be entiled to half of the money?

Hi Sandra

You can still divorce under Canadian law even though your husband is in jail. From your point of view it is better if he just signs the divorce papers rather than contesting them. Regarding the money he has in his account, you need to prove it was 'earned' whilst he was married to you to qualify for half of it. If it was inherited for example and he can prove this, you will not get a penny. With so much at stake you need to consult a good divorce lawyer asap.
